Collaborative Divorce

Collaborative Divorce

The Collaborative Family Law Process is a client-centered process about cooperation, not confrontation. It is mediation and problem solving with a collaborative team where the couple tries to understand each other. This process is most successful with a team of professionals that provide their own expertise to the group. The collaborative team can include:

  • Collaborative lawyers
  • Financial specialists
  • Child specialists
  • Divorce coaches

The collaborative process encourages the couple:

  • To treat each other with respect
  • To listen to each other's perspectives, interests and concerns
  • To explore all possible choices
  • To let go of the past in order to focus on the future

The financial specialist is the only neutral party in the collaborative team. The job of the financial specialist is to:

  • Educate the couple regarding financial past and future
  • Promote awareness of financial issues to be addressed
  • Prepare statements of marital assets and liabilities
  • Review budgets prepared for the couple
  • Evaluate various support and asset division proposals
  • Minimize post-divorce taxes and post-decree issues
  • Serve as a financial advisor (in some cases) following the dissolution of the marriage
